MUNICIPAL CIVIL REGISTRY OFFICE

I – REGISTRATION OF BIRTH:

Republic Act. No. 3753 mandates the establishment of civil registry in the Philippines where acts, events, legal instruments and court decrees concerning the civil status of persons shall be recorded. The birth of a child being a vital event for a person must be registered within 30 days from the time of birth at the Office of the Civil Registrar of the municipality where the birth took place. Beyond 30 days is considered late registration.

II – REGISTRATION OF DEATH

The spouse or nearest relative who has knowledge of the death of a person who died without medical assistance, must report the same to the Local Civil Registrar’s Office of the municipality where the event occurred within 24 hours. The Municipal Health Officer examines the cause of death, signs the death certificate, and directs the registration of the death certificate to the Office of the Mun. Civil Registrar (MCR) within the reglamentary period of 30 days.

IV – APPLICATION FOR MARRIAGE LICENSE

Before getting married, both the contracting parties must file separate sworn application for marriage license of the office of the municipal civil registrar where either or both of the contracting parties reside. Marriage license shall be valid in any part of the Philippines for not more than 120 days only from the date of issuance. Otherwise, it shall be deemed cancelled and expired.

REQUIREMENTS:

  1. Certificate of No Marriage Record (CENOMAR) from NSO
  2. Certified true/photocopy of birth certificate of the applicants.
  3. Pre–marriage counseling certificate (2 copies)
  4. Family planning seminar certificate (2 copies)
  5. Parental consent ( if applicant is 18 years old but below 21 years old )
  6. Parental advice ( if applicant is 21 years old but below 25 years old )
  7. At least one of the contracting parties is a resident where the local civil registry is located.

VII – LEGITIMATION

Legitimation is a remedy by means of which those who in fact were not born in wedlock considered as illegitimate; to be considered legitimate, it is being supposed that their parents were already validly married.
